DUI & Traffic Charges

DUI and DWAI Charges in Colorado

A Colorado DUI (“driving under the influence) or DWAI (“driving while ability impaired) charge arising from an allegation of drinking and driving or substance abuse can result in incarceration and an extended driver’s license revocation, even for a first offense. In addition, someone facing a DUI charge is often accused of a number of other traffic offenses arising from the same incident. A skilled and knowledgeable DUI defense attorney can negotiate pending traffic offenses with the goal of minimizing potential driver’s license consequences.

New law changes in Colorado have resulted in harsher Colorado DUI sentences which now require mandatory incarceration for repeat DUI offenders and longer terms of court supervision. Other recent revisions to Colorado DUI law have made it tougher to get your driver’s license reinstatement after it has been revoked for a pending DUI or DUI conviction.

Careless and Reckless Driving in Colorado

Careless driving is a 4 point traffic offence on your driver’s license. Careless driving can be a normal traffic accident charge or the more serious charge of Careless driving resulting in death or serious bodily injury to another person.  While the second charge is clearly more serious, both careless driving charges could result in convictions that mean a significant increase to insurance premiums as well as a potential license suspension if you have accumulated too many traffic charges over the last 12 to 18 months.

Reckless driving is an 8 point violation and also a major offense for habitual offender purposes.  A reckless driving conviction is very likely to lead to a large insurance premium increase or potential license cancellation.

If you are charged with either careless or reckless driving, you should seriously consider hiring a defense attorney to help protect your legal rights and your pocket book from a damaging potential conviction.

Other Traffic Violations

Most convictions for traffic violations in Colorado will cause you to have suspension points assigned to your license.  These violations may include red light and stop sign offenses to no insurance charges to driving while your license is under restraint.  Each of these offenses has fines and court costs associated with a conviction.  While some of these traffic violations can certainly be handled without the assistance of a criminal defense attorney, a seasoned and knowledgeable attorney on your side can sometimes make the difference between a point heavy conviction with substantial fines and a reduced charged plea bargain that could have significantly less impact on your future car insurance rates.
